Terms and Conditions
The following Terms and Conditions is a legal contract between an individual user and Open Air Booth regarding the use of our website and services.
By confirming your booking with Open Air Booth you are agreeing to the following Terms and Conditions:
DELIVERY AND HIRING
Delivery and set up is free of charge and will occur outside of your booked hire period at a time agreed upon by Open Air Booth and the hirer. The complete details and inclusions of your package will be disclosed to you at the time of your booking.
PAYMENTS
Your booth hire is confirmed once your deposit of $50 is received. The deposit is non-refundable as it secures the booth for you on your event date, therefore preventing us from taking other bookings for your booth. The remaining balance is due at least 7 days before the event date, unless otherwise agreed to in writing by both parties. Failure to pay the remaining balance may result in cancellation of your booking and loss of deposit. You’ll receive a reminder 2 weeks and 1 week prior to the due date.
SECURITY STATEMENT
Our banking details for direct deposit will be noted on your invoice and should not change at any time. If you receive any emails purporting to represent Open Air Booth, listing changes to our banking details, please contact Open Air Booth by phone before making any payments. We will not be held liable for payments made to the wrong location.
CANCELLATIONS
If a booking is cancelled by the hirer or their agent more than 7 days prior to the booked date then Open Air Booth will refund any amount they have paid, less the deposit that was used to secure your date.
If a booking is cancelled by the hirer or their agent within 7 days of the booked date, the deposit and all monies paid to that date will be forfeited, unless Open Air Booth can replace the hirer’s booking with a new booking, in which case all monies paid to that date will be returned to the hirer or their agent, less the deposit that was used to secure your date.
If Open Air Booth has not received final payment for a booking at least 7 days before the booked date, Open Air Booth will deem that as a cancellation on behalf of the hirer and all monies paid to date will be forfeited, unless both parties have made prior mutually agreed to arrangements in writing for a late payment.
POSTPONEMENT
If a hirer wishes to move a booking to another date it will be at the discretion of Open Air Booth as to whether this is a viable option. In most cases a postponement can be arranged, however if the management deems the postponement unviable, the booking will be deemed a cancellation and the above cancellation terms will apply.
DELAYS
Open Air Booth cannot be held responsible for unforeseen delays at the venue, which are out of our control.
TRAVEL
A travel surcharge may apply to events located more than 45km from our nearest base. Any travel charges must be agreed to by both parties and shall be disclosed in writing by Open Air Booth prior to booking.
EXTENDED BOOKING TIME
Should the client, or their representative decide to extend the booked time during the course of the event, the extended rates will be $100 per hour, payable at the beginning of the extended time, as a bank transfer or cash payment.
PRIVACY/USE OF IMAGES
When hiring from Open Air Booth the hirer gives permission for images captured at the event to be used on our website and for advertising purposes, unless the hirer requests otherwise, in writing, before the date of the event.
Open Air Booth will not use images which are deemed unsuitable or inappropriate for advertising and will not use any content that we consider may be personally damaging to any person(s).
Open Air Booth will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.
WORKPLACE HEALTH AND SAFETY REQUIREMENTS/RULES

The backdrops require an indoor smoke free space of approximately 2.5m x 2.5m x 2.5m

The photo booth requires one standard power outlet within 10 metres of the booth location.

If the photo booth and/or backdrops are to be set up outdoors, they will require sufficient protection from the elements in the form of sufficient overhead and side covers, to afford protection from rain, humidity, wind and/or sunlight. It is the hirer’s responsibility to ensure their venue or private function coordinator is made aware of these requirements and can accommodate them.

Children under the age of 10 must be accompanied by an adult when using the booth

Do not lean against the backdrop as it may not support your weight

Open Air Booth staff may pause or terminate the use of the photo booth at any time during the event if they consider that the guests are behaving in a way that the operator(s) believes to be dangerous to themselves or any persons, or potentially damaging to the product.

Open Air Booth staff reserve the right to exclude a person or persons from the photo booth area if they consider that person to be grossly intoxicated or behaving in an aggressive or abusive manner towards the photo booth attendant or behaving in a manner that the Open Air Booth staff considers may damage Open Air Booth’s property.
LIABILITY
At all times care will be taken by Open Air Booth to ensure delivery of the booked package, however should unforeseen equipment failure prevent this, during the normal course of event, liability will be limited to a total or partial refund of monies paid, dependant on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully.
Open Air Booth cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any venue or venue staff or is due to any negligence, act or fault on the part of any client or client guest or other person using Open Air Booth at your event/function, which negligence, act or fault, wilful or accidental in turn prevented the successful completion of the agreed to Open Air Booth service(s).
FORCE MAJUERE
Open Air Booth will not be liable for failing to perform under the agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, fire, threatened or actual act of terrorism, pandemic, natural disaster, extreme weather events (including but not limited to flooding, cyclones, earthquakes, which events might prevent the photo booth attendant from reaching the venue or to perform his/her duties whilst at the venue), or war.
